Taxpayers Against Awful Apartment Zoning Exemptions (TAAAZE), a Scottsdale-based advocacy group, has initiated legal proceedings to contest the city's recent rezoning agreement with Axon Enterprise, Inc.
The lawsuit, filed in Maricopa County Superior Court, targets the Memorandum of Understanding (MOU) between the city and Axon, asserting that it functions as a de facto zoning ordinance without adhering to the necessary public procedures.
According to TAAAZE, the MOU bypassed essential steps such as a housing impact statement and public hearings, thereby neglecting the rights of Scottsdale residents.
The group contends that the agreement grants Axon additional benefits not present in prior arrangements, particularly concerning water usage and inspection protocols.
In November, the Scottsdale City Council approved a revised plan allowing Axon to construct 1,200 housing units—comprising both apartments and condominiums—on a 70-acre campus near Loop 101 and Hayden Road.
This decision reduced the original proposal of 1,900 units, a move aimed at addressing community concerns.
Despite these adjustments, TAAAZE maintains that the MOU's approval process was flawed and is seeking judicial intervention to nullify the agreement.
The outcome of this legal challenge could significantly impact the future of Axon's headquarters project and set a precedent for how rezoning agreements are handled in Scottsdale. |
